Overstaying a China Visa: Penalties and What to Do

Staying in China beyond the period permitted by your visa or residence permit constitutes illegal residence. It can lead to a fine, detention, or even deportation with a ban on re-entry for a period of years. Understanding the statutory penalties and the correct way to handle the situation matters more than trying to fix it afterwards.

  • Penalties: Article 78 of the Exit and Entry Administration Law of the People's Republic of China provides that a foreigner who resides illegally in China shall be given a warning; where the circumstances are serious, the person shall be fined RMB 500 for each day of illegal residence, up to a total of RMB 10,000, or be detained for not less than five days but not more than 15 days.
  • Whether entry may be restricted: yes. Article 62 of the same law provides that a foreigner who resides illegally may be repatriated, and a person repatriated may not enter China for one to five years from the date of repatriation. Article 81 further provides that a foreigner who engages in activities inconsistent with the purpose of stay or residence, or who otherwise violates Chinese laws and regulations and is unsuitable to continue staying or residing in China, may be ordered to leave within a specified period; where the circumstances are serious but do not constitute a crime, the Ministry of Public Security may order expulsion, and a foreigner expelled may not enter China for ten years from the date of expulsion.
  • Extensions must be applied for in advance: where the stay period noted in the visa does not exceed 180 days, the holder stays in accordance with the period noted in the visa. To extend it, an application must be filed with the exit-entry administration of a public security organ at or above the county level in the place of stay no later than seven days before the noted stay period expires. Holders of residence permits must apply to the exit-entry administration of a public security organ at or above the county level in the place of residence no later than 30 days before the permit expires.
  • What to do after overstaying: there is no standard procedure for "extending after the deadline", because an extension application must be filed before the period expires. Once you have overstayed, you should promptly and voluntarily report the situation to the exit-entry administration of the public security organ at or above the county level in the place of your stay or residence and accept handling in accordance with the law; do not continue to stay or conceal the situation. Note also that the total period of extension may not exceed the stay period originally noted in the visa.
  • Impact on future visas: Article 21 of the law provides that a visa shall not be issued to a foreigner who has been expelled or ordered repatriated and for whom the prescribed period during which entry is prohibited has not expired. In other words, once an overstay has been handled in accordance with the law, it may directly affect any future application for a Chinese visa.
  • Other related obligations: an overstay is often accompanied by other breaches. Article 76 of the law provides that a foreigner who refuses to have his or her exit-entry documents inspected by a public security organ, refuses to submit a residence permit for examination, or fails to register accommodation as required by the second paragraph of Article 39 shall be given a warning and may also be fined not more than RMB 2,000.

It is worth noting that overstaying and applying for an extension are two different paths. As long as an application is filed in accordance with the law before the period expires, it is a normal extension; once the deadline has passed, the stay becomes illegal residence and is handled under Articles 78 and 62. So if an overstay has already occurred, the correct approach is to report the situation to the exit-entry administration promptly and voluntarily and accept handling, rather than waiting to explain at departure.

A few suggestions for visitors to China: note the stay period and validity period stated in your visa or residence permit and set an advance reminder on your phone or calendar; if you genuinely need to stay longer, apply for an extension within the deadlines above; and if objective reasons such as a cancelled flight or medical treatment may prevent you from leaving on time, keep the relevant supporting documents and inform the local exit-entry administration of the public security organ promptly.

The above is based on the Exit and Entry Administration Law of the People's Republic of China, the full text of which is available on the website of the National Immigration Administration. In individual cases, the decision of the exit-entry administration of the public security organ prevails.

The above is general guidance only. For specific requirements and the latest rules, please refer to official announcements.
