Extending a China Visa Stay: Deadline, Grounds and Documents

When the stay period printed on your Chinese visa is not long enough, the lawful route is to apply for an extension before it expires, not to wait until the final day. This summary sets out what China's Exit and Entry Administration Law says about extensions, stay permits and overstaying.

• Who can apply: foreigners whose visa states a stay period of no more than 180 days may stay in China on that visa for the period stated on it (Article 29, paragraph 1).
• When to apply: an extension must be requested at least seven days before the stated stay period expires, at the exit-entry administration of the public security authority at or above county level in the place where you are staying, with the supporting documents related to your reason for the request (Article 29, paragraph 2). The wording is "at least seven days before expiry", not on the last day.
• Whether it is granted depends on the reason: if the reason for extension is found reasonable and sufficient, the stay period is extended; if not, you must leave on time (Article 29, paragraph 2). A decision refusing an ordinary visa extension is final (Article 36).
• How long an extension can run: extensions may not in total exceed the stay period originally stated on the visa (Article 29, paragraph 3). In other words, an extension stays within the frame of the original stay period rather than renewing it indefinitely.
• Visa-free entry follows a different path: foreigners who entered without a visa and need to stay beyond the visa-free period must apply for a foreigner stay permit, which is valid for a maximum of 180 days (Article 34).
• What happens if you overstay: foreigners may not engage in activities unrelated to the purpose of their stay or residence and must leave before the permitted period ends (Article 37). Illegal residence is punishable by a warning and, in serious cases, a fine of 500 yuan per day of illegal residence up to a total of 10,000 yuan, or detention of five to fifteen days (Article 78).

The stay period is counted from the day after entry, which is widely misread. The visa Q&A published by the Chinese Consulate General in Sydney states that "duration of each stay" means the maximum number of days you may stay after each entry, counted from the day after arrival, while the visa itself remains valid until 24:00 Beijing time on the expiry date printed on it. These are two different dates: one tells you when you must leave, the other tells you whether you can still use the visa to enter.

As for documents, the law only says the applicant must submit materials related to the reason for the request "as required"; the actual checklist comes from the office handling the case. A passport and the accommodation registration slip are normally used, and where the reason is medical treatment, a cancelled flight or a prolonged business negotiation, the more specific the supporting proof, the better. Confirming the office hours and document list with the local exit-entry administration before you go saves a wasted trip with a stack of photocopies.

Two points are often confused. An extension only lengthens the stay period; it does not change the type of visa. If you need to remain long term, for work, study or family reunion, the route is not an extension but an application for the matching residence permit within 30 days of entry. And once an extension is refused there is no room to wait: Article 36 makes that decision final, so the only compliant step is to leave on time.
