Staying Longer After Visa-Free Entry: China's Stay Permit
Foreigners who entered China visa-free and need to stay beyond the visa-free period must apply for a stay permit rather than simply extending the visa-free arrangement.
- Who it applies to: Article 34 of the Exit and Entry Administration Law states that foreigners who entered China without a visa and need to stay beyond the visa-free period must apply for a foreigner stay permit in accordance with the regulations.
- Maximum validity: the same article sets the maximum validity of a foreigner stay permit at 180 days.
- Other cases covered by the same article: foreign crew members and their accompanying family members who need to leave the city where the port is located, or anyone in another situation requiring a stay permit.
- How it differs from a visa extension: visa holders use the extension route under Article 29 and must apply to the exit-entry administration of the public security authority at or above the county level in the place of stay at least seven days before the stay period noted on the visa expires. Timing: finish the process before the visa-free period ends. If officers ask you to supplement documents, the remaining days are often not enough, so leave a buffer and do not wait until the last day. The stay period counts from the day after entry; the arrival day itself is not counted.
The line not to cross: staying past the permitted period is illegal residence. Under Article 78 of the Exit and Entry Administration Law, a fine of 500 yuan per day of illegal residence, up to a total of 10,000 yuan, or detention of not less than five and not more than fifteen days, applies. Whether a stay permit is issued and for how long is decided by the public security authority after review; there is no guarantee of approval.
